When you purchase a Commercial
License you will receive a copy containing you name and organization,
information regarding the specific license you have purchased and any
addition terms and conditions you and I have agreed to.

COMMERCIAL LICENSE AGREEMENT/USAGE TERMS:
Thank you for purchasing one of my designs and the accompanying commercial
license. Please remember this license is non-transferable. The graphic files
you have purchased may not be redistributed or sold digitally or otherwise.
All graphic files included in this license are the product and property of
Marie Stones
and are only to be distributed by FreeDigitalScrapbooking.com.

These files - which are to be
considered a design tool rather than a final design product and are
licensed to the purchaser's computer only and are not to be shared,
loaned, rented, resold, distributed, transferred, or posted across a
bulletin board, network, modem, Internet or web page in their original
form. The purchaser has a license to create derivative designs using
these files - but is not licensed to re-distribute them in their
original format.

Do not make copies of these
files on any electronic or physical medium (including CDs, diskettes, or
other storage medium) for reasons other than back-up purposes. Do not
share these products with anyone.
Examples of
correct usage:

Creating cards, candy wrappers
or physical scrapbook layouts to sell to other individuals

Creating designs for
advertising such as filers, leaflets or broachers.

Creating personal website
designs or eBay auction backgrounds.
Examples of
incorrect usage:

Creating digital files to sell
or share with digital scrapbookers.

Creating digital files,
papers, page layouts, etc. to be sold to another company for
distribution.

Distributing the products
(meaning as they are received) directly to consumers.
The key
questions to ask yourself before undertaking a project using this license
and any digital products:

Am I distributing any digital
files?

Have I created a new product
or service of value?

Am I taking credit or obtain
profits that should go to the original designer?
If the answer to any of these questions is yes please contact me, Marie
Stones, marie@freedigitalscrapbooking.com at for further negotiations or
licensing clarifications.
Licensee hereby acknowledges that Licensee is licensing the Software for
commercial use as described. Licensee hereby agrees to pay liquidated
damages to Licensor in the amount of $5,000.00 for any non-allowed
commercial use. In addition, should Licensor incur any attorney fees or
other costs in collecting and/or enforcing this liquidated damages
provision, Licensee agrees to reimburse Licensor for all such fees and/or
costs. The parties acknowledge that the liquidated damages set forth above
are reasonable in amount, that actual damages would be extremely difficult
or impractical to determine and that any dispute or potential dispute over
actual damages would be disruptive to the businesses of the parties so that
it is in both parties’ best interest to have determined the amount of such
reasonable liquidated damages.
